    The Procurement Act 2023 replaces previous public sector procurement regulations. These changes will simplify the process for buyers, by increasing transparency, and creating a more competitive marketplace. Suppliers will have greater visibility of opportunities making it easier for them to work and engage with buyers in the public sector.

     

    When Did the Changes Go Live?

    The Procurement Act 2023 comes into effect on 24 February 2025. It is important for suppliers to familiarise themselves with the new procedures to ensure compliance.

    To make the most of the new procurement landscape, suppliers should:

     

    Key Changes Suppliers Should Know

    The cabinet office has introduced several new notices under the Act that will improve transparency and engagement during the procurement process, including:

    • Planned Procurement Notice: Allows buyers to signal upcoming opportunities before formal tendering begins, giving suppliers a head start.
    • Preliminary Market Engagement Notice: Enables early conversations between buyers and suppliers to shape future procurements.
    • Contract Award Notice: Provides clearer information on awarded contracts, ensuring transparency.
    • Contract Termination Notice: Informs suppliers when a contract has ended early, offering potential opportunities for re-tendering.
    • Key Performance Indicator (KPI) Notices: These highlight supplier performance on contracts, making performance a bigger factor in future tenders.
